GENERAL SALES CONDITIONS FOR DISTRIBUTORS

All orders must be sent in writing, the product and unit references must be provided in accordance with the current price list. The right to reject orders from customers that have not complied with previous contracts is reserved. The particular conditions cited on the customer’s order are void if they do not agree with the general conditions, unless expressly accepted.

DIRECT SALES IN COUNTRIES WITH NO DISTRIBUTORS

End users who wish to buy a machine in countries with no distributors may purchase it directly from us at Smaky. We ship it by courier for a net freight cost. Payment terms for these orders are in advance. Warranty is for manufacturing faults only and is valid for 1 year and the defect parts must be returned to Smaky. PRICES
The prices are quoted in USD or in EUR.

TRANSPORT AND PACKING
The merchandise shall always travel on account and risk of the customer, except a complete lorry: CIF. Any reshipments are on account and risk of the purchaser. All equipment includes individual packing. Additional charges shall be made in the case of requiring maritime or other special packing. Please check the condition of the shipment carefully when it arrives. Any complaints for damage or deterioration to the merchandise caused during transport shall not be accepted under any circumstances unless it is accompanied by verification of the complaint made by the purchaser to the transport company within the maximum legal period of 24 hours of receipt of the merchandise.

GUARANTEE
Smaky shall only be held liable for manufacturing defects, with any improper handling or use by the user or customer of the product being excluded. The guarantee shall be that established in accordance with current legislation. All replacements shall be invoiced and credited once Smaky examines and checks the defective parts.

RETURNS
Returns shall not be accepted unless authorised by Smaky. In all cases, the material shall be issued free of transport charges and expenses.

PAYMENT CONDITIONS
Bank transfer costs are not accepted. Until a customer is conceded credit facilities, all operations shall be paid in advance. If invoice payments are not made on the agreed dates, the customer shall be responsible for the return or delayed payment costs.

SPARE PARTS AND ACCESSORIES
All spare parts shall be sent freight collect and material returns shall not be accepted unless authorized by Smaky.

OWNERSHIP
All merchandise that is not fully paid for shall remain property of Smaky.

JURISDICTION
In this case, the competent tribunals will be those of Stockholm.

INFORMATION
Smaky, has the right to introduce, without previous advise, modifications in their products respecting the main characteristics.
